When should I submit a H-2A application?
To ensure compliance and smooth processing, H2A applications must be submitted at least 75 days before your anticipated start date. This timeframe allows for necessary reviews and approvals, ensuring that all requirements are met in a timely manner. Planning ahead is crucial to avoid any delays in obtaining the necessary workforce for your agricultural needs. When do departure forms need to be completed?
Please ensure that departure forms are filled out and submitted in writing within 48 hours of a workers departure from jobsite, with a completion of contract. Completing this form in a timely manner is essential for ensuring a smooth transition and proper documentation. What are the remuneration packages required for employees?
H-2A employers must provide workers with three daily meals or free cooking facilities. If meals are offered, the contract must state any charge, not exceeding actual costs, as published annually. Employers cover transportation and subsistence costs for travel to and from employment, including initial and end-of-contract travel. Free transport is provided between housing, the worksite, and weekly town trips. Workers' compensation insurance must meet state laws. Housing must be finalized 45 days before the start date. What are the compensation and payroll obligations?
Wages: Employers must pay the highest of AEWR, prevailing wage, piece rate, collective bargaining rate, or Federal/State minimum wage. If piece rates fall short of the hourly rate, pay will be adjusted. (20 CFR 655.120, 655.122)

Corresponding Employment: Non-H–2A workers can be employed under a Temporary Employment Certification for agricultural work during the job order's validity, including extensions.

Record Retention: Employers must keep accurate earnings records available for inspection within 72 hours at work sites or central offices. Records must meet regulations, be retained for 3 years post-certification, and include daily work hours and paystub details. (20 CFR 655.122(j) and (k))
What are the IRS requirements?
H-2A visa holders are exempt from U.S. Social Security, Medicare taxes, and federal income tax withholding unless Backup Withholding applies.
All H2A workers need a social security number. To obtain a Social Security Number, H2A workers need to visit the Social Security office and present the following documents: the completed SS-5 form, a valid passport, and the I-94 arrival/departure record.
